1. Overview and Acceptance

1.1. Introduction to SayNoCash:

SayNoCash is a digital platform operated by TechDiganta Pvt. Ltd.
We enable users to:

  •  Place food orders (Dine-In, Takeaway, Delivery, Homemade Food).
  •  Book hotel rooms.
  •  Connect with verified food and accommodation partners.

1.2. Agreement to Terms:

  • By using the SayNoCash website or app, both users and partners acknowledge and agree to these Terms & Conditions, which govern all services, transactions, and interactions facilitated by our platform.

 2. Services Provided

2.1. Core Service Offerings:

SayNoCash facilitates the following services:

  • Dine-In Orders.
  • Advance Takeaway Orders.
  • Home Delivery Orders.
  • Bulk & Scheduled Orders.
  • QR Code-Based Table Orders.
  • Hotel Room Bookings (Tatkal & Regular).
  • Homemade Meal Orders.

2.2. Platform Role:

  • SayNoCash acts solely as a platform connecting users with service partners. SayNoCash does not directly prepare, manage, or deliver food or hotel services unless explicitly stated.

3. User Accounts and Responsibilities

3.1. Account Registration:

Users may register accounts to manage preferences, track orders, and earn rewards.

3.2. User Obligations:

Users are responsible for:

  • Providing accurate and complete account details.
  •  Maintaining the confidentiality of login credentials.
  • Avoid posting false, abusive, or misleading content or reviews.

4. Orders and Cancellations

4.1. User Cancellation Policy:

Confirmed orders or bookings cannot be cancelled by users through the app.

4.2. Partner Cancellation Rights:

Partners (restaurants, hotels, home chefs) reserve the right to cancel orders or bookings due to:

  •  Item or service unavailability.
  •  Operational difficulties.
  •  Suspected fraud or misuse.

4.3. Refund for Partner Cancellations:

  • In the event of a partner cancellation, a full refund will be processed within 24 hours.

4.4. Processing Fee:

  • A processing fee of amount might be charged for payment gateway deductions.

5. Payments and Pricing

5.1. Secure Payment Gateways:

  • All payments made through the SayNoCash platform are processed via secure and integrated payment gateways, ensuring user safety and data protection.

5.2. Pricing Inclusions:

Prices displayed on the platform are inclusive of:

  •  Base product or service cost.
  •  Applicable taxes (GST).
  •  Delivery or service charges (as determined by the respective partner).

5.3. Additional Charges:

  • SayNoCash may apply additional charges based on specific services, delivery zones, or location-based logistics. These fees will be transparently displayed before checkout.

5.4. GST Compliance:

  • All transactions on the SayNoCash platform are compliant with applicable GST regulations. Users will receive GST-compliant invoices upon request or as required.

6. Delivery & Fulfillment

6.1. Restaurant Orders:

  • Delivery may be handled by restaurant staff or SayNoCash/third-party riders.
  • SayNoCash is only responsible for delivery if its own rider delivers the order.
  • Food quality and delays related to preparation are the Restaurant partner’s sole responsibility.

6.2. Homemade Food Orders:

  • Delivered exclusively by the homemade food partner.
  • The partner bears all responsibility for packaging, hygiene, and timely delivery.

6.3. Hotel Bookings:

  • SayNoCash does not manage room quality, hygiene, or hospitality.
  • Hotel partners are fully responsible for service delivery related to hotel bookings.

6.4. Future Delivery for Homemade Orders:

SayNoCash may offer delivery services for homemade orders in the future with prior notification. If SayNoCash handles delivery, it will only be liable for transport issues.

7. Refunds and Returns

7.1. Eligibility for Refunds:

Refunds may be granted in cases of:

  • Wrong or missing items.
  • Spoiled or poor-quality food.
  • Excessive delivery delays.

7.2. Refund Request Timeframe:

  • Refund requests must be raised within 24 hours of delivery.

7.3. Dispute Resolution Assistance:

  • SayNoCash may assist in dispute resolution, but the final approval for a refund lies with the partner.

7.4. No Returns Policy:

  • Due to the perishable nature of food items, returns are generally not accepted.

8. Partner Responsibilities

8.1. General Partner Obligations:

Partners must:

  • Ensure accurate menu listings, prices, and availability.
  • Comply with FSSAI, GST, and all local laws and regulations.
  • Resolve user complaints promptly.
  • Fulfill all confirmed orders and bookings.

8.2. Homemade Food Provider Specifics:

  • Homemade food providers must maintain hygiene, quality packaging, and timely delivery.

9. Data Privacy & Security

9.1. Compliance:

  • SayNoCash adheres to the Information Technology Act and the Personal Data Protection Bill (PDPB).

9.2. Data Usage:

  • User data is collected and used solely for service delivery, performance improvement, and security purposes.

9.3. Partner Data Restrictions:

  • Partners are strictly prohibited from misusing or sharing user data.

10. Liability and Indemnity

10.1. SayNoCash Limitations of Liability:

SayNoCash is not liable for:

  •  Food preparation or hotel-related service issues.
  •  Behavior of partner staff.
  •  Accidents, theft, or delivery delays occurring on the partner’s premises.

10.2. Partner Indemnification:

  • Partners shall indemnify SayNoCash against legal claims arising from their negligence or breach of obligations.

11. Dispute Resolution

11.1. Initial Resolution Attempt:

  • All disputes shall first attempt resolution through mutual discussion within days.

11.2. Arbitration:

  • If unresolved, matters shall proceed to binding arbitration under the Arbitration and Conciliation Act, 1996.

11.3. Arbitration Details:

  • Seat and Language of Arbitration: Kolkata, West Bengal, in English.

11.4. Jurisdiction:

  • Only courts in Kolkata, West Bengal, India, shall have jurisdiction over these Terms.

 12. Modification and Termination

12.1. Terms Modification:

  • SayNoCash reserves the right to modify these Terms & Conditions at any time.

12.2. Acceptance of Changes:

  • Continued usage of the platform implies acceptance of the latest terms.

12.3. Account Suspension/Termination:

  • SayNoCash may suspend or terminate accounts for violations of these Terms or misuse of the platform.
